1. Acceptance of Terms

By creating an account or using FYNBIT's platform, services, or website (collectively, the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service. These Terms form a legally binding agreement between you ("Merchant" or "User") and FYNBIT ("we", "us", or "our").

2. What FYNBIT Does

FYNBIT is a Software-as-a-Service (SaaS) technology platform that helps merchants create checkout pages, generate payment links, collect payments, and manage settlements — all from a single dashboard.

FYNBIT is a technology intermediary — not a Payment Aggregator, Payment Gateway, or bank. All payment processing is performed by RBI-licensed Payment Aggregators integrated with our platform. FYNBIT does not hold, pool, or commingle merchant funds at any point.

3. Merchant Eligibility & Verification

To use the Service, you must:

  • Be at least 18 years of age
  • Be a legal entity or individual authorized to conduct business in India
  • Successfully complete our KYC (Know Your Customer) verification
  • Maintain a valid bank account in India in your legal name or business name
  • Comply with all applicable Indian laws, including GST regulations

We reserve the right to reject or suspend any account that does not meet our verification standards.

4. Permitted Use

FYNBIT may be used solely for lawful purposes to collect payments for legitimate goods and services. The following are expressly prohibited:

  • Gambling, betting, lottery, or fantasy sports (unlicensed)
  • Adult content or services
  • Drugs, narcotics, or controlled substances
  • Pyramid schemes, Ponzi schemes, or multi-level marketing
  • Counterfeit or stolen goods
  • Any activity prohibited under the laws of India
  • Services materially different from those disclosed during KYC

5. Fees & Settlements

FYNBIT charges a 5% platform fee per successful transaction. An additional 2% payment gateway charge is deducted at cost — this is passed through at exactly what our payment aggregator partner charges to process the transaction.

Total deduction: 7% per successful transaction. The net proceeds are settled to your registered bank account within T+2 business days, subject to our payment aggregator's processing timelines. FYNBIT is not responsible for delays caused by banking system failures or force majeure events.

FYNBIT's 5% platform fee is non-refundable once a transaction is processed successfully. GST at 18% is applicable on the 5% platform fee component only.

6. Refund Policy

Merchants are solely responsible for their refund policy toward their end customers. For FYNBIT's refund handling process, please refer to our Refund Policy.

7. Account Security

You are responsible for maintaining the confidentiality of your account credentials and API keys. Do not share API keys publicly or in client-facing code. FYNBIT is not liable for unauthorized transactions arising from your failure to secure account credentials.

8. Account Suspension & Termination

We reserve the right to suspend or terminate your account with or without notice if:

  • You violate these Terms
  • We identify fraudulent or suspicious activity
  • Your account poses an elevated chargeback or fraud risk
  • You fail to maintain required KYC compliance

Upon termination, pending settlements will be processed in accordance with applicable laws and our payment aggregator's policies, subject to any holds required for dispute resolution.

9. Chargebacks & Disputes

As a merchant, you are responsible for resolving payment disputes and chargebacks raised by your customers. FYNBIT will assist by providing transaction records and evidence to support your case. Excessive chargebacks (above standard industry thresholds) may result in account review or suspension. A chargeback reserve may be maintained at our discretion for elevated-risk categories.

10. Intellectual Property

All software, dashboards, trademarks, and content provided by FYNBIT are our intellectual property or licensed to us. You may not copy, reverse-engineer, resell, or redistribute any part of our platform without express written consent.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. We do not warrant that the Service will be error-free at all times.

12. Limitation of Liability

To the maximum extent permitted by applicable law, FYNBIT's total liability for any claim arising from or relating to the Service shall not exceed the total fees paid by you to FYNBIT in the three months preceding the claim. FYNBIT is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or business interruption.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in India. Courts in India shall have exclusive jurisdiction for interim relief.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or dashboard notification with at least 30 days' notice. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
